Atlassian Cloud Terms

The Atlassian Customer Agreement (ACA) governs customer access to Atlassian Cloud and Data Center product offerings and establishes the contractual framework under which organizations and their authorized users engage with Atlassian services. The agreement states that customers are responsible for their users' compliance with the agreement, that Atlassian may modify fees with notice and suspend services for non-payment or policy violations, and that the terms authorize Atlassian to use customer data to provide, improve, and develop its services including for AI and machine learning features. The agreement asserts a mutual indemnification structure, caps Atlassian's liability at fees paid in the prior twelve months, and includes a class action waiver alongside mandatory arbitration for certain dispute categories, provisions that may be subject to jurisdictional limitations particularly in the EU and certain US states. The agreement engages GDPR through its Data Processing Addendum (DPA) by reference, CCPA through its privacy policy, and relevant consumer protection frameworks administered by the FTC; enterprise customers contracting under the ACA should evaluate whether the incorporated DPA and sub-processor disclosures satisfy their own data controller obligations. The arbitration and class action waiver provisions create heightened compliance review needs for US-based enterprise procurement teams, and the breadth of the AI and machine learning data use authorization warrants mapping against applicable AI governance frameworks.
