These terms govern how you and your team are allowed to use Atlassian's cloud products, and they assign responsibility for everything your users do to you as the customer. Atlassian can change the agreement, suspend your access, or remove your data, and your subscription will renew automatically at potentially higher prices unless you act. If something goes wrong, the most Atlassian owes you is limited to what you paid for the relevant products in the past twelve months, and there are no implied guarantees about product quality or fitness.
The Atlassian Cloud Terms establish a subscription-based agreement under which Atlassian grants customers and their Affiliates a non-exclusive, worldwide right to use its Products and related Support and Advisory Services for internal business purposes only. Atlassian retains unilateral power to modify the Agreement with commercially reasonable efforts to provide thirty days' notice, to suspend or restrict access to Cloud Products and Customer Data, and to renew subscriptions automatically at then-current rates. The Agreement caps each party's aggregate liability at fees paid for the relevant products in the twelve months preceding a claim, disclaims all implied and statutory warranties, and places full accountability for user conduct on the customer. Atlassian bears an ongoing contractual obligation to maintain an information security program protecting Customer Data, and must defend the customer against third-party intellectual property infringement claims arising from authorized use of the Products.
As a user, your account and data access can be suspended or restricted by Atlassian, and your organization—not Atlassian—is responsible for how you and other users behave under the agreement. You cannot use the cloud products to upload patient or protected health information unless your organization has separately signed a Business Associate Agreement with Atlassian. You should be aware that your subscription renews automatically at Atlassian's then-current rates, so you or your organization must take affirmative action before the renewal date to avoid being billed at a new price.
