Hims & Hers Terms and Conditions

This document sets the rules for using Hims & Hers's products and services, which you pay for entirely out of pocket with no insurance coverage. If you have a legal dispute with Hims & Hers, you must resolve it through private arbitration rather than in court, and you cannot join a class action. Hims & Hers can change these terms at any time without warning, and once your medication ships, no refund is available.

This Agreement establishes the terms under which users access Hims & Hers's Platform and services on a cash-basis structure explicitly outside any federal or state healthcare program, placing sole financial responsibility on users for all product and service costs. Hims & Hers reserves the right to revise or remove any part of the Agreement or Service in its sole discretion at any time without prior notice, with changes effective upon posting. The Agreement disclaims all warranties of any kind and caps Hims & Hers's liability at the lesser of actual damages or $1,000, while requiring users to defend, indemnify, and hold harmless Hims & Hers Parties and Third Parties for claims arising from users' own conduct. Disputes are channeled exclusively to confidential binding arbitration before a single NAM commercial arbitrator on an individual basis, foreclosing class, collective, or representative proceedings, with a thirty-day opt-out window available to users upon first becoming subject to the Arbitration Agreement.

As a user, you are automatically charged at regular intervals for your subscription until you cancel, bear full responsibility for all product and service costs, and cannot obtain a refund for any medication once it has shipped; refunds for partially used subscription periods are not provided as a right and are granted only in Hims & Hers's sole and absolute discretion. Your ability to sue Hims & Hers in court is eliminated by a mandatory arbitration clause, and any recovery is capped at $1,000 in actual damages. If you wish to opt out of the Arbitration Agreement, you must do so within thirty days of first becoming subject to it.
