PlanetScale Terms of Service

This document sets the rules for using PlanetScale's database platform. You receive a limited, revocable right to use the service for your internal business needs, all fees are non-refundable and non-cancelable, and you bear full responsibility for anything you submit to or receive from AI features. PlanetScale's maximum liability to you is capped at fees paid in the six months before your claim arose, and you irrevocably release PlanetScale from all liability related to AI Output.

PlanetScale's Terms of Service establishes a revocable, nonexclusive, nontransferable, nonsublicensable license for customers and end users to access the Product solely for internal business purposes. The agreement imposes full customer responsibility for all AI Inputs and Outputs—including legal and contractual compliance—and couples that with an irrevocable release of PlanetScale and its Affiliates from all liability related to AI Output, including copyright claims. Customer Content rights are broadly granted to PlanetScale, its Affiliates, and any third party PlanetScale authorizes, while all fees are non-refundable and non-cancelable. Liability is capped at direct damages not exceeding fees paid in the six months preceding the claim, with a full exclusion of indirect, consequential, punitive, and related damage categories; PlanetScale provides a defined U.S. patent and copyright infringement defense for claims arising from the Product itself.

As a PlanetScale customer, you grant PlanetScale, its Affiliates, and any third party PlanetScale authorizes broad rights to access, use, process, store, host, display, and transmit your content. Any fees you pay are non-refundable and non-cancelable under all circumstances. You are prohibited from storing or processing GDPR special-category personal data or HIPAA-regulated health information on the platform unless you have an executed HIPAA BAA in place for the latter. You bear full legal and contractual responsibility for all AI Inputs and Outputs, and you irrevocably release PlanetScale from all liability—including copyright claims—arising from AI Output. If you submit feedback, PlanetScale and its Affiliates hold a royalty-free, perpetual, worldwide, transferable, sublicenseable, irrevocable license to use, modify, and distribute it without restriction.
