(1) REGULATORY FRAMEWORK: Post-termination data retention and deletion provisions must comply with GDPR Art. 28(3)(g), which requires processors to delete or return all personal data to the controller after the end of the provision of processing services. The 25-day window for data export is a controller-side obligation; HubSpot's deletion thereafter must be confirmed in writing per GDPR requirements. CCPA does not impose specific post-termination data return requirements in service provider agreements, but data deletion must be consistent with CCPA §1798.105 consumer deletion rights. Data retention obligations under sector-specific laws (HIPAA, SOX, FINRA) may require Customer to maintain records beyond the HubSpot retention period. (2)
