The agreement caps Atlassian's financial liability to customers at the total fees paid in the twelve months prior to the event giving rise to a claim, which limits the potential recovery available to customers regardless of the scale of harm. The agreement also requires most disputes to proceed through individual arbitration rather than court, and includes a class action waiver, which affects how customers can pursue grievances.
