Continued use as implied consent means consumers may inadvertently agree to less favorable terms without taking any affirmative action.
Zillow's terms affect consumers primarily through a mandatory arbitration clause that removes the right to sue in court or participate in class actions, a broad perpetual license over any content users submit, and explicit consent to being contacted by phone, text, or email including by automated systems. The liability cap of $100 means consumers are significantly limited in the damages they could recover even if Zillow breaches the agreement. You can opt out of the arbitration clause by sending written notice to Zillow within 30 days of first agreeing to the terms.
