This analysis describes what Unreal Engine's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology
This is a significant and non-standard restriction that directly prohibits a growing use case in the tech industry — using game engine assets or renders to train AI systems — and breach could expose organizations to contract termination and damages claims.
Developers and studios using Unreal Engine for commercial products may owe Epic either seat subscription fees or a 5% royalty on gross revenues above $1,000,000 per product, depending on how they use and distribute the engine. The agreement also prohibits using Unreal Engine or MetaHuman assets as training input for AI systems, which may affect studios exploring AI-assisted workflows. You can review the seat subscription exceptions in Section 6(b) to determine whether the personal, indie, educational, or non-commercial exemptions apply to your organization.

'Generative AI Program' means artificial intelligence, machine learning, deep learning, neural networks, or similar technologies designed to automate the generation of or aid in the creation of new content, including but not limited to audio, visual, or text-based content; or use, or permit others to use, MetaHuman digital characters and animation curves (or any rendered output thereof if crafted to replicate the functionality of MetaHuman) to build or enhance any database or training or testing any artificial intelligence, machine learning, deep learning, neural networks, or similar technologies.— Excerpt from Unreal Engine's Unreal Engine EULA
