What it is

You are not allowed to use any Netflix content or service data — including through prompting or interaction — to train, test, or build any AI or machine learning system.

Why it matters (compliance & risk perspective)

This is an unusually broad prohibition that covers not just scraping or downloading but also interactive use such as prompting, which could affect researchers, developers, and even ordinary users who use AI tools in conjunction with Netflix.

Institutional analysis (Compliance & legal intelligence)

(1) REGULATORY FRAMEWORK: This provision engages copyright law (17 U.S.C. §106 in the US; EU Copyright Directive 2019/790, Art. 3-4 on text and data mining), contract law enforceability, and emerging AI-specific regulatory frameworks including the EU AI Act (Regulation 2024/1689). Netflix's IP rights in its content underpin this restriction. The US Copyright Office's ongoing AI and copyright rulemakings are directly relevant. Primary enforcement authority lies with Netflix contractually and through civil IP litigation, with potential FTC involvement if the clause is used in a deceptive or anticompetitive manner. (2)
