The collection of precise location data and trip details, combined with use for purposes described in a separate Privacy Notice incorporated by reference, means the full scope of data use is not entirely contained within these terms and requires review of an additional document.
Interpretive note: The full scope of data use and third-party sharing is governed by a separately incorporated Privacy Notice, which must be reviewed concurrently to assess the complete data practices applicable to users.
The agreement states that Uber collects precise or approximate location data, trip origin and destination, device information, usage data, and communications; the full scope of how this data is used and shared is governed by Uber's Privacy Notice, which is incorporated by reference into these terms.

"When you use the Services, we collect information such as your precise or approximate location, trip origin and destination, trip details, device information, usage data, and communications between you and Uber or between you and your Driver. (1) REGULATORY LANDSCAPE: Collection and use of precise geolocation data engages the CCPA and CPRA for California residents, including the right to opt out of sale or sharing of personal information and the right to limit use of sensitive personal information. GDPR applies to EU/EEA users and requires a lawful basis for processing location and communications data, as well as compliance with data minimization and purpose limitation principles. The FTC has issued guidance on geolocation data and consumer privacy. (2) GOVERNANCE EXPOSURE: High. Precise geolocation data is classified as sensitive personal information under the CPRA and as special category-adjacent data under GDPR for certain processing contexts. The incorporation of data use terms by reference to a separate Privacy Notice means the full compliance posture depends on the Privacy Notice's provisions and update cadence. (3) JURISDICTION FLAGS: California residents have CPRA rights to limit use of sensitive personal information, including precise geolocation. EU/EEA users have GDPR rights including access, rectification, erasure, and portability of personal data. Illinois BIPA may be relevant if biometric data is collected in any service context. Washington State's My Health MY Data Act and other state privacy laws create an evolving compliance landscape for geolocation data. (4) CONTRACT AND VENDOR IMPLICATIONS: Enterprise customers and B2B partners who process Uber-collected data in connection with business travel or delivery programs should assess whether data processing agreements are in place consistent with GDPR Article 28 and CCPA service provider requirements. (5) COMPLIANCE CONSIDERATIONS: Compliance teams should maintain current data mapping for all categories of personal data collected by Uber and shared with third parties, and should audit whether consent mechanisms and opt-out rights are operationally consistent with CCPA, CPRA, and GDPR requirements. The Privacy Notice incorporated by reference should be reviewed concurrently with these terms.
