REGULATORY FRAMEWORK: CPRA Cal. Civ. Code §1798.121 classifies precise geolocation (within a 1,850-foot radius) as sensitive personal information requiring opt-in consent for use beyond specified service purposes. Colorado CPA, Connecticut CTDPA, and Virginia CDPA similarly restrict use of precise geolocation for advertising without opt-in consent. FTC Act Section 5 applies to deceptive location data practices; the FTC's 2024 settlement with X-Mode ($275K) and action against Kochava establish active enforcement in location data for advertising. The Stored Communications Act (18 U.S.C. §2701) may apply to location data stored by Samsung.
