Any statute of limitations will be tolled while the parties engage in the informal dispute resolution process described in this section.Excerpt from Ticketmaster's Terms of Use
1. REGULATORY LANDSCAPE: The FTC and state attorneys general have examined mandatory pre-dispute cooling-off and meet-and-confer requirements as potential barriers to consumer dispute access. The FAA governs the procedural enforceability of this requirement. The statute of limitations tolling provision has implications for applicable state limitation periods that may vary by claim type and jurisdiction. 2. GOVERNANCE EXPOSURE: Medium. The 60-day mandatory meet-and-confer requirement, including a personal teleconference or videoconference, creates a procedural barrier to formal dispute initiation that may disadvantage consumers without legal representation or reliable access to communication technology. The confidentiality provision applicable to all statements made during the informal resolution process limits the evidentiary use of those discussions in subsequent proceedings. 3. JURISDICTION FLAGS: Courts in certain jurisdictions have evaluated similar mandatory pre-arbitration cooling-off periods and found them enforceable; others have found them to constitute an unconscionable barrier to dispute access. California courts present particular exposure given the citation of California procedural statutes elsewhere in the arbitration clause. 4. CONTRACT AND VENDOR IMPLICATIONS: The requirement to disclose counsel's name and contact information in the initial notice may affect litigation strategy for represented parties. The confidentiality provision covering all informal resolution communications, including those of agents and attorneys, should be noted in litigation hold protocols. 5. COMPLIANCE CONSIDERATIONS: Compliance teams should ensure that the disputes@ticketmaster.com address is operationally monitored as specified, and that internal protocols exist to schedule the required teleconference or videoconference within the 60-day window. Failure to comply with the pre-arbitration requirements on Ticketmaster's side may affect the enforceability of the arbitration clause in specific cases.
