What it is

The agreement states that Comcast retains ownership and title to all leased equipment at all times, including after a subscriber pays an Unreturned Equipment Fee. Payment of the fee does not transfer ownership, and the equipment may not be resold, used, or operated even after the fee is paid.

Why it matters (compliance & governance perspective)

This provision establishes that the Unreturned Equipment Fee is a penalty for failure to return equipment rather than a purchase price, and that subscribers who pay it remain prohibited from using or disposing of the equipment while Comcast retains legal title.

The updated terms now explicitly prohibit the deployment of AI Agents to access, use, interact with, or take action on Comcast services unless Comcast expressly grants permission. This includes automated activities such as obtaining information, making requests, monitoring activity, copying, downloading, scraping, or data mining the services. The agreement also prohibits AI Agents from accepting terms on a user's behalf or engaging in support or sales interactions. Users who currently use automation tools or third-party integrations with Comcast services may need to seek express permission from Comcast or discontinue such automated access.

For avoidance of doubt, Xfinity Equipment remains Comcast-owned equipment, and Comcast retains title to all Xfinity Equipment, at all times, including but not limited to after payment of an Unreturned Equipment Fee. "Unreturned Equipment Fee" refers to a fee charged by Comcast to a subscriber for any unreturned Xfinity Equipment upon termination of the Services provided under this Agreement. The payment of an Unreturned Equipment Fee shall not result in a sale of, or the transfer of title to, any Xfinity Equipment, and such Xfinity Equipment shall remain the property of Comcast, and Comcast retains title to Xfinity Equipment at all times. Comcast in no way relinquishes ownership of (including title to) Xfinity Equipment by the payment of an Unreturned Equipment Fee. Even if an Unreturned Equipment Fee has been paid, Xfinity Equipment shall not be resold, used, or operated in any manner.

ConductAtlas Analysis

Institutional analysis (regulatory & governance intelligence)

REGULATORY LANDSCAPE: The retained title provision and the characterization of the Unreturned Equipment Fee as liquidated damages rather than a purchase price engage general contract law principles and may require evaluation under state consumer protection statutes that regulate fee disclosures and equipment rental agreements. The FTC's consumer protection authority is relevant to the clarity and fairness of fee characterizations in consumer contracts. GOVERNANCE EXPOSURE: Medium. The provision is operationally specific and transparent about the ownership structure, but the prohibition on use or resale of equipment after payment of a fee may raise consumer expectations issues if subscribers are not clearly informed at the point of termination that payment does not transfer ownership. JURISDICTION FLAGS: State consumer protection statutes in California and New York that regulate equipment rental agreements and fee disclosures may create heightened exposure. State laws governing personal property and abandoned property may also interact with Comcast's retained ownership claim for equipment that has been physically lost or destroyed. CONTRACT AND VENDOR IMPLICATIONS: The retained title provision means that Comcast equipment appearing in secondary markets constitutes property that the original subscriber was not authorized to transfer. This has implications for third-party resellers and refurbishers who may acquire Comcast equipment through consumer channels. COMPLIANCE CONSIDERATIONS: Subscriber communication materials at the point of service termination should clearly disclose that payment of the Unreturned Equipment Fee does not transfer ownership, and that the equipment remains prohibited from use or resale. The 10-day return window should be prominently communicated to avoid fee disputes.
