(1) REGULATORY FRAMEWORK: This indemnification provision implicates FTC Act Section 5 standards for unfair contract terms in consumer-facing agreements; state consumer protection statutes (California Consumers Legal Remedies Act, Cal. Civ. Code §1770) where the clause may be unconscionable if applied to non-commercial users; and copyright liability under 17 U.S.C. §501 in the context of AI-generated content infringement claims currently before multiple federal courts. The FTC has enforcement authority over unfair or deceptive terms in standard-form contracts. (2)
