These Terms govern how you can use Oscar Health's Services — personal use only, not for business purposes. If you submit any content, Oscar Health gets a permanent, irrevocable license to use it, including to train its AI systems. If something goes wrong, Oscar Health's financial responsibility to you is capped at $100 or three months of fees, and you must resolve any dispute with Oscar Health individually, not as part of a class action.
Oscar Health's Terms of Use establish the conditions under which users may access and interact with the Services, limiting permitted use to personal, non-commercial purposes for the user and their family members or dependents. The document grants Oscar Health a perpetual, irrevocable, royalty-free, worldwide, sublicenseable license over User Submissions and expressly permits Oscar Health to use de-identified and anonymized User Submissions to train, optimize, and enhance its AI Technology. Liability exposure is constrained through a full disclaimer of warranties on an as-is basis, a direct-damages cap at the greater of three months of fees paid or $100.00, and a designation of health content as informational-only used at the user's sole risk. Dispute resolution is confined to individual arbitration, prohibiting class arbitrations and class actions, and users bear broad indemnification obligations for all liabilities arising from their use or misuse of the Services. Oscar Health retains unilateral discretion to modify the Terms with notice only for material changes, and to suspend, discontinue, or terminate user access for any reason.
As an individual user, you are bound by several provisions that directly affect your rights. Health information on the Services is provided for informational purposes only, and you bear sole responsibility for how you rely on it. AI-generated content may be inaccurate or unreviewed by a human, and you are responsible for verifying its accuracy. Any content you submit becomes subject to a permanent, irrevocable, royalty-free license that Oscar Health may sublicense to third parties. If you have a dispute, you must pursue it individually rather than joining a class action or class arbitration, and any financial recovery for direct damages is capped at the greater of fees you paid in the prior three months or $100.00. You are also responsible for defending and indemnifying Oscar Health from claims arising out of your use or misuse of the Services. Oscar Health can change the Terms at any time; material changes will be communicated by a notice posted on the Services or sent to you by email.
