This provision asserts that users own AI-generated outputs, which has practical implications for commercial use of content created with ChatGPT, but the qualification 'to the extent permitted by applicable law' acknowledges ongoing legal uncertainty about AI-generated content ownership.
Interpretive note: The agreement asserts assignment of output rights, but the copyrightability of AI-generated content under US and EU law remains legally uncertain, qualifying the practical scope of this provision.
The agreement authorizes OpenAI to use content users submit, including prompts and conversation inputs, to provide and improve its services, and limits OpenAI's liability for damages to the greater of fees paid in the prior 12 months or $100. Users are required to resolve most disputes through individual binding arbitration, waiving the right to participate in class actions. You can opt out of the mandatory arbitration clause by sending a written notice to OpenAI within 30 days of first accepting these terms, using the process described in the dispute resolution section.
