This provision establishes that OpenAI services are not intended for children under 13, and that parental consent and assumption of responsibility are required for teenagers aged 13 to 17, which has implications for how minors' data is handled and how liability is allocated.
Interpretive note: The adequacy of consent mechanisms for minors aged 13-17 and the enforceability of parental responsibility provisions may vary by jurisdiction, particularly in EU member states with higher digital consent ages under GDPR Article 8.
The agreement authorizes OpenAI to use content users submit, including prompts and conversation inputs, to provide and improve its services, and limits OpenAI's liability for damages to the greater of fees paid in the prior 12 months or $100. Users are required to resolve most disputes through individual binding arbitration, waiving the right to participate in class actions. You can opt out of the mandatory arbitration clause by sending a written notice to OpenAI within 30 days of first accepting these terms, using the process described in the dispute resolution section.
