You are personally and fully responsible for any content or models you upload to Replicate, and Replicate has no liability if your content causes harm or legal issues.
If you upload a model or content that infringes someone's copyright, violates privacy laws, or causes harm, you are solely liable for the consequences — Replicate is completely shielded, even if their platform facilitated the harm.

(1) REGULATORY FRAMEWORK: This provision engages Copyright Act 17 U.S.C. §512 (DMCA safe harbor) which protects platforms from liability for user-uploaded content but does not eliminate user liability. It also implicates GDPR Art. 82 (liability for data protection violations) — if Customer uploads personal data in AI model inputs, Customer bears the data controller liability. State biometric privacy laws (Illinois BIPA, 740 ILCS 14/1 et seq.) create per-violation exposure for Customer if biometric data is processed through uploaded models. The FTC and state AGs are primary enforcement authorities for consumer protection violations. (2)
