What it is

Coinbase charges an additional service fee on DEX trades beyond the standard trading fee, may retain any excess service fee, and explicitly excludes this fee from the Coinbase One subscription's zero-fee trading benefit.

This analysis describes what Coinbase's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology

ConductAtlas Analysis

Why it matters (compliance & governance perspective)

This provision establishes a fee category for DEX trades that operates independently of the Coinbase One subscription benefit structure, meaning subscribers who pay for zero-fee trading are nonetheless subject to a separate service fee on all DEX transactions. The document also states that DEX aggregators routing trades may retain any price improvement over the quoted price as a fee.

The updated fee schedule removes the pre-published 1% fee for instant unstaking and instead discloses the fee only at the moment a user requests to unstake. This means users can no longer review the exact cost before initiating a transaction through the published schedule. The revision also explicitly includes converting a pending standard unstake to an instant unstake as a fee-triggering action. No fee continues to apply if a user waits for the full unbonding period.

The agreement states that the execution price will not increase more than the slippage tolerance displayed before order placement.

In addition to the standard Coinbase fee, Coinbase may charge an additional service fee for transactions that occur on decentralized exchanges (DEXs) with our DEX Trading feature. Part of this service fee may be used to cover network fee payments. Coinbase may retain any excess service fee from a transaction. This service fee is not eligible for Coinbase One Zero Fee Trading benefits.

ConductAtlas Analysis

Institutional analysis (regulatory & governance intelligence)

REGULATORY LANDSCAPE: DEX trading features that route orders through third-party aggregators may implicate SEC broker-dealer registration requirements and FINRA rules depending on the nature of the routing and fee-sharing arrangements. The FTC may have interest in whether the Coinbase One subscription benefit exclusion for DEX service fees is disclosed with sufficient prominence to avoid deceptive practice findings. GOVERNANCE EXPOSURE: Medium. The explicit carve-out of DEX service fees from Coinbase One benefits creates a disclosure risk if subscription marketing materials do not equally prominently disclose this limitation. The statement that DEX aggregators may retain price improvement as a fee introduces a third-party cost element that is not fully quantified in this document. JURISDICTION FLAGS: EU MiCA regulations may impose transparency obligations on DEX routing and fee practices. US users in states with active digital asset regulatory frameworks, including New York and California, may have additional disclosure rights regarding third-party fee retention in routing arrangements. CONTRACT AND VENDOR IMPLICATIONS: The involvement of DEX aggregators as third parties who retain price improvement creates a vendor relationship that may require disclosure in institutional agreements. Procurement and compliance teams should assess whether the DEX aggregator fee structure is adequately disclosed in service agreements. COMPLIANCE CONSIDERATIONS: Compliance teams should assess whether the Coinbase One subscription marketing and onboarding flows disclose the DEX service fee exclusion with sufficient prominence. The slippage tolerance mechanism and the aggregator price improvement retention should be evaluated under applicable best execution and disclosure standards.
