Under UCC §2-316, implied warranty disclaimers must be conspicuous — the all-caps presentation satisfies this requirement under most US state commercial codes. EU Consumer Rights Directive (2011/83/EU) Art. 24 and EU Sale of Goods Directive (2019/771) Art. 10 impose mandatory conformity guarantees that cannot be disclaimed for consumer contracts, rendering this clause partially unenforceable in the EU. UK Consumer Rights Act 2015 §31 similarly prohibits disclaimer of statutory rights.
