Stability AI gives you a limited, revocable right to use its Site for noncommercial and informational purposes only. If you have a dispute with Stability AI, you must resolve it through binding arbitration as an individual — you cannot sue in court or join a class action — and the most Stability AI will ever owe you is $100. Continuing to use the Site after any Terms update means you have agreed to the new Terms.
This document establishes the terms under which Stability AI grants users a limited, non-exclusive, revocable, and personal license to access the Site solely for noncommercial and informational purposes. It imposes a binding arbitration requirement for all disputes, with an accompanying class-action waiver and jury-trial waiver, and separately requires an irrevocable jury-trial waiver for any proceedings not subject to arbitration. Stability AI's total liability to any user is capped at $100, all warranties are disclaimed on an 'as is' and 'as available' basis, and indirect or consequential damages are excluded entirely. Users must file any claim within one year of accrual or be forever barred, and continued use of the Site following any change to the Terms constitutes agreement to those changes. Stability AI retains sole discretion to determine who qualifies as a repeat copyright infringer and to terminate or disable access in appropriate circumstances accordingly.
As an individual user, you receive a revocable, noncommercial-only license to the Site with no warranty guarantees. All disputes must go through individual binding arbitration rather than court, you waive jury-trial rights even for matters outside arbitration, and your total recovery is capped at $100. You must bring any claim within one year of when it arose, or it is permanently barred. If Stability AI determines you are a repeat copyright infringer, it will terminate or disable your Site access. Because the entire Arbitration Agreement becomes null and void if any provision of Paragraph 2 is found invalid or unenforceable, a user whose arbitration terms are invalidated by a court or arbitrator would no longer be bound by that agreement.
