ConductAtlas Analysis

Institutional analysis (regulatory & governance intelligence)

(1) REGULATORY LANDSCAPE: This provision engages GDPR Articles 15 through 22 (data subject rights), CCPA/CPRA consumer rights provisions, UK GDPR equivalent rights, and U.S. state privacy laws in Virginia, Colorado, Connecticut, Texas, and others that include access, deletion, portability, and appeal rights. The EDPB, national supervisory authorities, California Privacy Protection Agency, and State AGs have enforcement jurisdiction. (2) GOVERNANCE EXPOSURE: Low to Medium. The provision covers the range of rights required by GDPR and major U.S. state privacy laws. The inclusion of an appeal mechanism for refused requests satisfies CPRA and several state law requirements. The rights are stated as conditional on applicable local law, which is standard but means some rights may not be available to all individuals. (3) JURISDICTION FLAGS: EU and UK residents have the most comprehensive rights under GDPR. California residents have CPRA-specific rights including the right to know categories of data shared for advertising. U.S. state privacy laws in Virginia, Colorado, Connecticut, Texas, and others provide appeal rights that this provision appears to address. (4) CONTRACT AND VENDOR IMPLICATIONS: Organizations using Salesforce as a processor must maintain procedures to route data subject requests received from their customers or employees to Salesforce where Salesforce holds the relevant data. The DPA should address response timelines and cooperation obligations. (5) COMPLIANCE CONSIDERATIONS: Compliance teams should verify that the online rights request form, email, and phone channels are operational and that response timelines comply with GDPR Article 12 (one month, extendable to three) and CCPA/CPRA (45 days, extendable to 90). The TRUSTe dispute resolution pathway and supervisory authority complaint rights should be documented in employee and consumer privacy notices.
