This mechanism directly reduces the compensation Pinecone may owe a Customer whenever the Customer's own non-compliance generates regulatory costs for Pinecone, potentially eliminating recoverable amounts.
If your failure to comply with DPA obligations causes Pinecone to face regulatory penalties, the amount of those penalties is deducted from any liability Pinecone would otherwise have to you.
