TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PELOTON, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES. IN NO EVENT SHALL PELOTON'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNTS PAID BY YOU TO PELOTON IN THE TWELVE (12) MONTH PERIOD PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY.
