Upon account closure, whether initiated by the user or by Microsoft, users lose immediate access to the Services, and associated data and content are deleted or disassociated, with no stated recovery mechanism. Closure may also result in forfeiture of purchased content licenses, memberships, and account balances.

"Closure of your access to a Service or your account may result in forfeiture of content licenses, associated content, memberships, and Microsoft account balances associated with the account. If your Microsoft account is closed (whether by you or us), a few things happen. First, your right to use the Microsoft account to access the Services stops immediately. Second, we'll delete Data or Your Content associated with your Microsoft account or will otherwise disassociate it from you and your Microsoft account (unless we are required by law to keep it, return it, or transfer it to you or a third party identified by you). You should have a regular backup plan as Microsoft won't be able to retrieve Your Content or Data once your account is closed. Third, you may lose access to products you've acquired.Excerpt from Xbox's Terms of Use
(1) REGULATORY LANDSCAPE: The forfeiture of purchased digital content licenses upon account closure may engage consumer protection frameworks in the EU, UK, and individual U.S. states, particularly where digital goods have been purchased with monetary value. The EU Consumer Rights Directive and UK Consumer Rights Act may interact with the enforceability of forfeiture provisions for paid digital content. The CFPB and state consumer financial protection agencies may have interest in the forfeiture of monetary account balances upon closure. (2) GOVERNANCE EXPOSURE: High. The combined effect of data deletion, content license forfeiture, and account balance forfeiture upon closure creates significant consumer-facing exposure, particularly where closure is initiated by Microsoft as an enforcement action under Section 4.b rather than by the user voluntarily. (3) JURISDICTION FLAGS: EU/EEA and UK users may have stronger statutory protections regarding forfeiture of paid digital content under applicable consumer law. California and other U.S. states with active consumer protection enforcement may scrutinize the forfeiture of monetary balances and prepaid content upon unilateral account closure. Illinois and New York may also present heightened exposure. (4) CONTRACT AND VENDOR IMPLICATIONS: B2B procurement teams and platform integrators should note that enforcement actions under Section 4.b can trigger account closure with immediate effect, with potential forfeiture of associated digital assets and balances. This creates operational dependency considerations for any workflow relying on Microsoft consumer account infrastructure. (5) COMPLIANCE CONSIDERATIONS: Legal teams should evaluate whether the forfeiture provisions comply with applicable consumer protection law in key jurisdictions, particularly the EU, UK, and California. The interaction between the enforcement-triggered closure provision in Section 4.b and the forfeiture clause should be reviewed against the proportionality requirements of applicable consumer and data protection law.
