Synthesia Terms of Service

This is Synthesia's Terms of Service for business customers who pay to create AI-generated videos using digital avatars. The most important thing to know is that by uploading your likeness, voice, or video content to create a custom AI avatar, you grant Synthesia a broad licence to use that content — and Synthesia can suspend your account immediately if it determines you've violated its content policies, without a refund obligation. If you're a business customer, review the acceptable use policy carefully and ensure your own users are contractually bound to the same rules before giving them access.

This document governs the contractual relationship between Synthesia (an AI video generation platform) and its business customers, establishing the terms under which customers access Synthesia's AI avatar and video production services on a subscription or usage basis. The most significant obligations include strict acceptable use policies prohibiting the creation of deepfakes, non-consensual intimate imagery, or content designed to deceive, alongside requirements that customers ensure their users comply with these terms through a flow-down obligation mechanism. Notably, Synthesia reserves broad rights to suspend or terminate accounts for violations of its usage policies at its sole discretion, and it retains a wide intellectual property licence over customer-submitted content used to train or improve its AI models, which deviates from typical SaaS terms. The document engages GDPR (as a data processor under Article 28), the EU AI Act (given avatar generation implicates biometric and synthetic media regulation), and CCPA given the involvement of US customers; compliance teams should note that the DPA incorporated by reference governs personal data processing and that enterprise customers bear responsibility for downstream user compliance through explicit contractual flow-down requirements.
