Stability may use submitted Inputs and Outputs to improve and develop its services, including training its models, unless users opt out through the mechanism referenced in Section 4c.

This provision authorizes the use of user-submitted content, including text, images, and other inputs, for model training and service development. An opt-out mechanism is available but requires affirmative user action; the default position under the terms is that Inputs and Outputs may be used for training.
Interpretive note: The lawful basis for processing Inputs and Outputs for model training under GDPR is not specified in this document; the Privacy Policy governs data processing details and would need to be reviewed to assess full regulatory exposure.
Under this clause, submitted Inputs and Outputs are available for Stability's use in model training and service improvement by default. Users who do not affirmatively opt out through the mechanism linked in Section 4c operate under terms that permit this use of their submitted content.

"As described in our Privacy Policy, we may use Inputs and Outputs to improve and develop our Services (but you can opt-out to prevent us from using your Inputs and Outputs to train our models, learn more), comply with applicable law, enforce our terms and policies, and to keep our Services safe.Excerpt from Stability AI's Terms of Service
1. REGULATORY LANDSCAPE: This provision engages GDPR Articles 6 and 9 for EU and UK users, requiring Stability to establish a lawful basis for processing Inputs and Outputs for model training. For California users, CCPA requires disclosure of data use practices and may require evaluation of whether the opt-out mechanism satisfies opt-out of sale or sharing requirements. The EU AI Act may require evaluation in the context of training data transparency obligations for general-purpose AI models. 2. GOVERNANCE EXPOSURE: High. The default-on data use posture for model training requires affirmative opt-out, which engages consent and legitimate interests analysis under GDPR. Organizations submitting proprietary or sensitive content via the API should assess whether their data governance frameworks permit this default use, and whether contractual protections are available through enterprise agreements. 3. JURISDICTION FLAGS: EU and UK users have heightened exposure given GDPR lawful basis requirements for using personal data in model training. California users may evaluate the provision against CCPA opt-out of sharing provisions. Enterprise users in regulated industries such as healthcare or financial services should assess whether submission of Inputs containing regulated data is permissible under the terms and applicable sector regulation. 4. CONTRACT AND VENDOR IMPLICATIONS: API users and enterprise customers building products on Stability's infrastructure should assess whether their own privacy policies and data processing agreements accurately reflect downstream use of their users' submitted content for model training, and whether vendor data processing agreements with Stability address this use case. 5. COMPLIANCE CONSIDERATIONS: Compliance teams should map the opt-out mechanism against GDPR consent and legitimate interests documentation requirements, update privacy notices to reflect Stability's potential use of submitted data for model training, and assess whether the opt-out is operationally accessible and clearly disclosed to end users accessing services through API integrations.
