What it is

This analysis describes what Shein's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology

ConductAtlas Analysis

Why it matters (compliance & governance perspective)

This provision establishes the operational mechanism and consequences of exercising a deletion right, disclosing that fulfillment of a deletion request results in irreversible loss of account-associated monetary and loyalty value, which is a material operational consequence consumers should be aware of prior to submitting a request.

Previously, Shein asked users to explicitly agree or disagree with account persistence for future logins. The updated terms remove this choice entirely. Instead of a consent decision, users now see a promotional discount offer in that location. This means users lose direct control over whether Shein maintains their login session across device visits, which affects convenience and privacy preferences around authentication persistence.

ConductAtlas Analysis

Institutional analysis (regulatory & governance intelligence)

1. REGULATORY LANDSCAPE: This provision engages the right to deletion under the CCPA, CPRA, and analogous state privacy statutes in Colorado, Virginia, Texas, Connecticut, and others. These statutes permit businesses to retain personal data necessary for legal compliance, dispute resolution, and security purposes, but require that deletion requests be fulfilled for data not subject to these exceptions. The California Privacy Protection Agency holds enforcement authority over deletion request handling procedures and timelines. 2. GOVERNANCE EXPOSURE: Medium. The disclosure that deletion results in loss of wallet credits and loyalty points of monetary value may engage consumer protection frameworks depending on how these credits are classified under applicable law. The retention of order history for financial reporting purposes is a standard exception under state privacy statutes, though compliance teams should verify that retention is limited to the minimum period required. 3. JURISDICTION FLAGS: California's CPRA imposes specific timelines for responding to deletion requests and requires businesses to notify third parties to whom data has been disclosed to delete the data as well. Similar requirements exist under Colorado and Virginia statutes. The disclosure that pending orders may delay deletion request fulfillment should be assessed for alignment with applicable response timeline requirements. 4. CONTRACT AND VENDOR IMPLICATIONS: The policy's statement that SHEIN will instruct service providers to delete data upon a verified consumer deletion request should be reflected in data processing agreements with all third-party processors. Compliance teams should verify that downstream deletion obligations are operationally implemented and contractually enforceable. 5. COMPLIANCE CONSIDERATIONS: Legal teams should evaluate whether the operational consequence of wallet credit and loyalty point forfeiture upon deletion request creates a material disincentive to exercise deletion rights that could be scrutinized under applicable state enforcement postures. Response timeline compliance and third-party deletion notification procedures should be audited for alignment with CPRA and applicable state statute requirements.
