Prohibition on Circumvention of Platform Transactions

Medium severity
Share 𝕏 Share in Share 🔒 PDF

What it is

You are not allowed to use Poshmark to find buyers or sellers and then complete the actual transaction outside the platform to avoid paying Poshmark's fees.

Consumer impact (what this means for users)

This clause financially binds all transactions that originate from Poshmark connections to the platform's 20% commission structure — even if a buyer and seller would prefer to transact elsewhere, doing so risks losing their Poshmark accounts.

Why it matters (compliance & risk perspective)

Violating this rule can result in account suspension, and it means you must pay Poshmark's commission on all sales initiated through platform interactions regardless of where you'd prefer to transact.

You agree not to contact other users through the Services to conduct transactions outside of the Services or otherwise circumvent Poshmark's fee structure.

Institutional analysis (Compliance & legal intelligence)

REGULATORY FRAMEWORK: Platform anti-circumvention clauses are generally enforceable under contract law but may face scrutiny under competition law if used by a dominant marketplace to foreclose competition. The FTC Act Section 5 and EU competition law (TFEU Article 102) may apply if Poshmark is found to hold a dominant position in a relevant secondhand apparel marketplace. P2B Regulation (EU) 2019/1150 restricts platforms from preventing commercial users from offering different conditions on other channels only in limited circumstances.
