Users must affirmatively represent either that they have no specified cardiovascular, musculoskeletal, or dizziness-related health conditions, or that their physician has approved use of the Peloton Service. Peloton reserves the right to refuse or cancel membership if it determines these representations are untrue.
This analysis describes what Peloton's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology
This provision establishes a contractual health affirmation requirement as a condition of service use and reserves the right to terminate membership based on medical condition determinations. The provision creates a representation that may affect liability allocation in the event of injury during use of the service or connected equipment.
Interpretive note: The practical mechanism by which Peloton would determine that a user's health affirmations are untrue is not described in the document, creating uncertainty about how this termination right would be operationally applied.
The agreement requires users to affirm specific health status representations as a condition of membership, and authorizes Peloton to cancel membership if it determines those representations are inaccurate. Users with any of the listed health conditions are required to obtain physician approval before using the service.

1) REGULATORY LANDSCAPE: Health-related affirmation requirements in consumer fitness contracts may engage state consumer protection statutes and, depending on how health data associated with these affirmations is handled, may interact with applicable privacy frameworks including CCPA for California residents. The affirmation does not itself constitute a medical screening, and the terms disclaim any medical advice function. 2) GOVERNANCE EXPOSURE: Medium. The affirmation creates a contractual representation by users regarding health status, which may affect liability allocation in personal injury claims arising from equipment use. The reservation of the right to cancel membership based on medical condition determinations raises questions about how Peloton would obtain or verify such information in practice, which is not addressed in this document. 3) JURISDICTION FLAGS: Disability discrimination considerations under the Americans with Disabilities Act may be relevant if membership cancellation based on medical conditions is applied to individuals with qualifying disabilities, though the document includes a physician-approval pathway that may address this concern. Jurisdiction-specific analysis would be required. 4) CONTRACT AND VENDOR IMPLICATIONS: Corporate wellness program administrators deploying Peloton should be aware that the health affirmation requirement applies individually to each user and cannot be waived at the organizational account level. Employer liability considerations may arise if employees are encouraged to use the service without adequate disclosure of this affirmation requirement. 5) COMPLIANCE CONSIDERATIONS: Legal teams should evaluate whether the health affirmation requirement, as a condition of service access, creates obligations under disability accommodation frameworks. The interaction between this provision and Peloton's data practices regarding health-related user representations should be assessed in the context of applicable privacy law.
