These terms govern your use of Mistral AI's products and set the rules for billing, data use, and disputes. If you are on a free, Vibe Pro, or Vibe Student plan, Mistral AI uses your data to train its AI models unless you opt out. Any dispute with Mistral AI must go through binding arbitration rather than court, and you cannot join a class action against them.
The Mistral AI Terms of Service establish the conditions under which users may access and use Mistral AI's products, including account-control restrictions that limit each account to a single individual and prohibit credential sharing or resale. The document sets out Mistral AI's data-usage rights, including a worldwide royalty-free license to use user data for providing, maintaining, and optimizing its products, with a sublicense right extending to delegates and subcontractors, and a provision permitting use of user data for AI model training for users on free, Vibe Pro, or Vibe Student plans who have not opted out. Liability is substantially limited: Mistral AI excludes indirect, incidental, special, consequential, and exemplary damages entirely, and caps total liability at the greater of twelve months of payments or one hundred US dollars. Dispute resolution is channeled exclusively to binding individual arbitration, with a mutual class-action waiver. Payments are non-refundable absent applicable law, and subscriptions renew automatically until cancelled by the user.
As an individual user, your data may be used to train Mistral AI's AI models if you are on a free, Vibe Pro, or Vibe Student subscription — you can opt out of training to prevent this. Your paid subscription renews and is charged automatically at every renewal period until you cancel, and payments are non-refundable except where law requires otherwise. If something goes wrong, your financial recovery is capped at the greater of what you paid in the last twelve months or one hundred dollars, indirect and consequential damages are excluded entirely, and you must resolve any dispute through individual binding arbitration rather than in court.
