"We engage third parties to help us facilitate targeted advertising designed to show you personalized ads based on predictions of your preferences and interests developed using personal data we maintain and personal data our third-party partners obtain from your activity over time and across nonaffiliated websites and other services. The data we and our third-party partners use for purposes of facilitating targeted advertising, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research, are primarily collected through the use of a variety of automatic data collection technologies, including cookies, web beacons, pixels, embedded scripts, mobile SDKs, location-identifying technologies and logging technologies. We may share a common account identifier (such as a hashed email address or user ID) with our third-party advertising partners to help link the personal data we and our third-party partners collect to the same person, or otherwise target advertising to an individual on a third-party website or platform.Excerpt from LlamaIndex's Privacy Policy
1) REGULATORY LANDSCAPE: Cross-context behavioral advertising engages CCPA and CPRA opt-out rights for sharing personal data for cross-context behavioral advertising purposes. Under GDPR, the use of cookies and tracking technologies for advertising requires a valid consent basis under the ePrivacy Directive and GDPR. The FTC has issued guidance on behavioral advertising and its authority over unfair or deceptive practices is relevant. The California Privacy Protection Agency enforces CPRA opt-out requirements. 2) GOVERNANCE EXPOSURE: Medium. The policy provides multiple opt-out pathways through DAA, NAI, and device-level controls but does not describe a direct first-party opt-out mechanism on the LlamaIndex platform for cross-context behavioral advertising. The sharing of hashed email addresses with ad networks as persistent cross-platform identifiers is a material disclosure. 3) JURISDICTION FLAGS: California creates heightened exposure through CPRA's opt-out of sale or sharing for cross-context behavioral advertising requirements. EU and EEA users require valid consent before targeted advertising cookies and tracking technologies may be deployed. 4) CONTRACT AND VENDOR IMPLICATIONS: The policy identifies Google Analytics and associated DoubleClick cookies as specific advertising technology deployments. Enterprise customers should assess whether their deployment of LlamaIndex in their own products could result in their end users' data being used for LlamaIndex's own advertising purposes. 5) COMPLIANCE CONSIDERATIONS: Legal teams should evaluate whether LlamaIndex's cookie consent and preference management mechanisms satisfy GDPR and ePrivacy requirements for EU users. CPRA compliance reviews should confirm that opt-out of sharing for cross-context behavioral advertising is available and functional. Data mapping should document hashed email address sharing with ad network partners as a separate disclosure category.
