(3) JURISDICTION FLAGS: In EU jurisdictions, if feedback incorporates personal data, GDPR processing obligations apply and the irrevocable license structure may conflict with data subject rights including erasure under Article 17. Organizations in jurisdictions with strong moral rights protections for authored works should also evaluate applicability. (4) CONTRACT AND VENDOR IMPLICATIONS: Organizations with confidential product development workflows or competitive sensitivity in their ML model operations should evaluate whether submission of feature requests or performance feedback could inadvertently disclose proprietary operational details under this license structure. The clause does not carve out feedback that is designated as confidential by Customer. (5) COMPLIANCE CONSIDERATIONS: Compliance teams may want to establish internal guidance on what categories of feedback Authorized Users submit to Baseten, particularly where feedback might reference proprietary model architecture, performance characteristics, or customer-specific operational parameters.
