AI21 Labs can cut off your access to any of its services at any moment, for any reason or no reason at all, without telling you in advance.
This analysis describes what AI21 Labs's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology
Developers and businesses that have built products or workflows dependent on AI21's API face the risk of sudden, unannounced service disruption with no guaranteed notice period or transition time.
The updated terms remove the explicit "Your Opt-Out Rights" button that previously allowed users to opt out of data sales and targeted advertising. In its place, the revised language establishes a general cookie consent framework requiring users to click "Accept" to allow cookies for site navigation, usage analysis, and marketing efforts. Users retain the ability to choose not to allow certain cookie types, but the prior dedicated opt-out mechanism for data sales and targeted advertising is no longer explicitly described in the accessible terms interface. If you wish to control cookie preferences, you can click on the cookie settings to modify consent for different types of cookies; however, strictly necessary cookies cannot be declined as they are required for core website functionality.
View change record →Simplified and consolidated the provision by removing service modification/discontinuation language, removing the 'for any reason' and 'if AI21 believes you have violated these Terms' conditions, and adding 'effective immediately' to emphasize immediate enforcement.
View full change record →If you rely on AI21's services in your own product or daily workflow, your access could be revoked immediately and without explanation. This provision creates meaningful operational risk for developers with production deployments on AI21's platform.

"AI21 may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, effective immediately.— Excerpt from AI21 Labs's AI21 Labs Terms of Use
(1) REGULATORY LANDSCAPE: Unilateral termination clauses are common in cloud and SaaS agreements, but their enforceability and fairness may be evaluated under the EU's Digital Markets Act or Unfair Contract Terms Directive in the context of business users, and under applicable state commercial law in the US. Where AI21 is processing personal data, termination procedures must align with GDPR Article 28 obligations requiring processors to assist in data return or deletion upon contract termination. (2) GOVERNANCE EXPOSURE: Medium for consumer users; High for enterprise API customers. For businesses that have integrated AI21's API into production systems, sudden termination without notice could cause business interruption, breach of the customer's own service-level commitments to its end users, and data access loss. The absence of any guaranteed notice period or cure opportunity is operationally distinct from enterprise-tier norms. (3) JURISDICTION FLAGS: EU business users may have additional protections under the Platform-to-Business Regulation (P2B Regulation, EU 2019/1150), which requires at least 30 days' notice of termination for online intermediation services. Enterprise customers in regulated industries should also assess whether sudden service termination could trigger regulatory reporting or business continuity obligations. (4) CONTRACT AND VENDOR IMPLICATIONS: Procurement teams should negotiate a minimum notice period (typically 30 to 90 days) and a data return procedure as conditions of any enterprise engagement. Vendor risk assessments should flag this clause as creating a business continuity risk. Standard enterprise SaaS agreements typically include cause-based termination procedures with cure periods rather than unrestricted at-will termination. (5) COMPLIANCE CONSIDERATIONS: Compliance teams should ensure that any integration of AI21 services into production systems includes a documented contingency plan for sudden termination, and that customer data stored in AI21's environment can be exported prior to or promptly after termination. GDPR-compliant data processing agreements should specify data return or deletion timelines triggered by contract end.
