What it is

Writer retains all intellectual property rights in its platform, software, model weights, algorithms, and all platform-side materials. Users retain rights in their Input and Writer assigns any rights it may have in Output to the user, to the extent permitted by applicable law.

This analysis describes what Writer's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology

ConductAtlas Analysis

Why it matters (compliance & governance perspective)

This provision establishes the allocation of intellectual property rights between users and Writer, including an explicit assignment of Output rights to users. The phrase 'to the extent permitted by applicable law' and 'if any' in the Output assignment clause acknowledge legal uncertainty about the copyrightability of AI-generated content.

Interpretive note: The legal status of copyright in AI-generated Output is unsettled under U.S. and EU law, and the practical scope of the Output assignment depends on resolution of these questions.

Consumer impact (what this means for users)

Under this clause, users retain rights in their Input and receive an assignment of any rights Writer holds in Output. The qualification 'if any' in the Output assignment reflects the unsettled legal question of whether AI-generated content is eligible for copyright protection under applicable law.
