Certain countries or jurisdictions may impose regulatory constraints on giveaways. If you run a giveaway, you are solely responsible for complying with applicable law. You explicitly acknowledge that Telegram is not liable in the event of sanctions, fees, and any form of legal or administrative action incurred as a result of or in relation to your use of the "Giveaway" feature provided by Telegram. Channel admins can use the Giveaway feature to announce arbitrary prizes in addition to premium subscriptions. Should they choose to do so, they are solely responsible for delivering said prizes to giveaway winners. Telegram will not be liable if any disputes arise in relation to the prizes, their delivery or lack thereof.

ConductAtlas Analysis

Institutional analysis (Compliance & governance intelligence)

(1) REGULATORY LANDSCAPE: Giveaways and prize promotions are regulated in most jurisdictions under consumer protection, gambling, and sweepstakes law. In the US, state sweepstakes laws and FTC endorsement guidelines apply. In the EU, promotional games are regulated by national law under frameworks that vary significantly by member state. Lottery and gambling regulations may apply if consideration is required for entry, creating criminal exposure for non-compliant organizers. (2) GOVERNANCE EXPOSURE: Medium to High for channel administrators who use the Giveaway feature commercially. The broad liability exclusion asserted by Telegram is common in platform terms but may face challenge in jurisdictions that restrict contractual liability waivers for consumer-facing activities. The explicit acknowledgment extracted from users ('you explicitly acknowledge') is designed to strengthen Telegram's liability defense. (3) JURISDICTION FLAGS: US operators must assess state-by-state sweepstakes and lottery laws, including no-purchase-necessary requirements and registration obligations in certain states. EU operators face varied national promotional rules. UK operators are subject to the Gambling Act 2005 framework. Australian operators must comply with state-specific trade promotion lottery laws. (4) CONTRACT AND VENDOR IMPLICATIONS: Businesses using the Giveaway feature for marketing campaigns should treat this clause as a contractual assumption of full legal risk, requiring legal review of applicable promotional law before launch. Agencies running giveaways on behalf of clients should assess indemnification obligations in their own client contracts. (5) COMPLIANCE CONSIDERATIONS: Organizations planning to use the Giveaway feature should conduct a jurisdiction-by-jurisdiction regulatory review, obtain required permits or registrations, and ensure prize fulfillment mechanisms are in place before launching. Legal counsel should assess whether the 'explicit acknowledgment' in the ToS constitutes an enforceable liability waiver in the relevant jurisdiction.
