Teladoc Terms of Use

This is the Terms and Conditions agreement for Teladoc Health's telehealth websites and mobile platforms, covering how users may access services, what data Teladoc Health collects and monitors, and the legal terms governing the relationship between users and the company. The agreement authorizes Teladoc Health to monitor user activity on the platforms and use cookies, log files, and browsing data, and grants the company a perpetual, royalty-free, worldwide license to use any feedback users submit for any commercial or non-commercial purpose without obligation to the user. Teladoc Health reserves the right to terminate user access for any reason without prior notice, and disclaims liability for all categories of damages including direct and consequential losses arising from platform use or service unavailability.

This document governs user access to and use of Teladoc Health's telehealth websites and mobile platforms, establishing a legal agreement between Teladoc Health Inc. (including affiliates Best Doctors, HealthiestYou, and Teladoc Physicians, P.A.) and individual users, effective July 1, 2019, under Delaware law. The agreement asserts that Teladoc Health may revise terms in its sole discretion without prior notice, grants users a limited revocable license to use the platforms, authorizes monitoring of user activity including cookies and browsing data, and reserves the right to terminate user access for any reason without prior notice. The agreement asserts a broad limitation of liability excluding all direct, indirect, special, punitive, incidental, exemplary, and consequential damages arising from platform use or service unavailability, and establishes a perpetual, royalty-free, worldwide license over any user-submitted feedback; these assertions may be subject to constraints under applicable consumer protection law depending on jurisdiction. The terms engage HIPAA given that the platform facilitates access to telemedicine and handles personal health information, and COPPA given the explicit prohibition on use by children under 13; the Delaware exclusive jurisdiction clause may create practical barriers for users outside Delaware, and the absence of explicit arbitration or class action waiver provisions is notable relative to many comparable telehealth platform agreements.

The agreement establishes that Teladoc Health may monitor user activity on the platforms and use cookies, log files, and browsing data as described in the Cookie Policy. Under these terms, any feedback a user submits to Teladoc Health is subject to a perpetual, royalty-free, worldwide license for any commercial or non-commercial use at Teladoc Health's sole discretion, with no obligation to the user.
