Unilateral Agreement Modification

Medium severity
Share 𝕏 Share in Share

What it is

We may update or modify this Agreement (including any additional policies or guidelines that form part of this Agreement) at any time by providing you Notice. Your continued use of the Services following any changes to this Agreement constitutes your acceptance of those changes.

Why it matters

This clause allows Stripe to materially alter the terms of your contract — including fee structures, reserve policies, and acceptable use restrictions — without your explicit consent, simply by notifying you.

Consumer impact

Businesses using Stripe may have their payouts withheld or placed in reserve for up to 180 days based on Stripe's unilateral risk assessment, potentially disrupting cash flow with limited recourse. Stripe can terminate or suspend accounts immediately, cutting off access to payment processing and potentially funds held in reserve. You can review and negotiate reserve terms before signing, and should maintain alternative payment processing arrangements as a contingency.

Applicable agencies

  • FTC
The FTC evaluates whether 'continued use' consent mechanisms for material contract changes constitute deceptive practices under FTC Act Section 5.
