The updated terms explicitly state that automated agents, bots, APIs, and AI-based tools accessing your account on your behalf are covered by the agreement, and you are responsible for all actions those tools take. Previously, the terms referenced electronic agents more generically. The revised language directly obligates account holders for automated activity, meaning if a buy-for-me agent, API, or bot violates platform rules through your account, you bear liability for that violation. The updated terms also remove country-specific overrides that previously applied in the UK, Italy, France, Germany, Japan, and South Korea, meaning the main terms now apply uniformly across those jurisdictions without regional exemptions.

ConductAtlas Analysis

Institutional analysis (regulatory & governance intelligence)

1. REGULATORY LANDSCAPE: Minor user provisions engage COPPA in the US, which applies to online services directed at children under 13 and imposes parental consent requirements. The terms state services are intended for users 18 and older, which may affect COPPA applicability. State consumer protection laws and age verification requirements may also engage depending on the jurisdiction. 2. GOVERNANCE EXPOSURE: Medium. The joint and several liability framework imposed on parents or guardians is significant and may not be adequately understood by users permitting minor access. The prohibition on minors acting as sellers is a clear operational restriction. 3. JURISDICTION FLAGS: Age of majority varies by jurisdiction; the terms reference the age of legal majority in the user's jurisdiction as the operative threshold, which creates variation across markets. EU member states may impose different standards for minor user consent and parental liability in online commerce. 4. CONTRACT AND VENDOR IMPLICATIONS: Platform operators permitting minor access under parental consent should ensure that consent mechanisms are adequate and that parental liability disclosures are clear and prominent. The joint and several liability provision creates enforceable financial obligations for guardians. 5. COMPLIANCE CONSIDERATIONS: Compliance teams should evaluate whether the platform's age verification mechanisms are adequate to enforce the 18-and-older intended use standard, whether parental consent mechanisms satisfy applicable legal requirements including COPPA, and whether the joint and several liability provision is adequately disclosed to parents and guardians before they permit minor access.
