What it is

Generated by a model from the captured document; not read by a person

The terms prohibit users from bringing or participating in class, collective, consolidated, private attorney general, or representative actions against Spotify in either arbitration or court, and waive the right to a jury trial to the fullest extent permitted by applicable law. Injunctive relief in arbitration is limited to individual relief only.

Why it matters (compliance & governance perspective)

Generated by a model from the captured document; not read by a person

This provision establishes that claims against Spotify must be brought individually, which structurally limits the availability of aggregate remedies for users with low-value individual claims. The private attorney general action waiver may interact with California's Private Attorneys General Act, and applicable law may limit enforcement of this waiver in certain contexts.

If You Do Nothing

⚠ Disputes will proceed on an individual basis as stated in the terms, without the ability to join class or representative proceedings

YOU AND SPOTIFY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER IN ARBITRATION OR LITIGATION ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION. Unless both you and Spotify agree, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of representative or class proceeding. The arbitrator may award injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
