This means if a third party sues Shopify because of something related to your store — such as a product liability claim or intellectual property dispute — you could be required to cover Shopify's legal defense costs.
Shopify merchants agree to mandatory arbitration and waive their right to join class action lawsuits, significantly limiting legal recourse if disputes arise with Shopify. Shopify can suspend or terminate a merchant's store at any time, potentially disrupting a business with little or no notice, and Shopify's financial liability is capped at amounts paid in the previous 12 months. You can opt out of the arbitration clause by sending written notice to Shopify within 30 days of first accepting the Terms, as specified in the dispute resolution section.
