ConductAtlas Analysis

Why it matters (compliance & governance perspective)

This provision modifies the dispute resolution mechanism by establishing arbitration as the mandatory forum for claim resolution and structuring proceedings on an individual rather than aggregate basis. The operational effect is that disputes proceed through a private arbitration process with defined procedural rules rather than through the court system.

Interpretive note: Enforceability of the class action waiver and retroactive application to pre-existing claims may vary by US state; California in particular has a history of scrutinizing such provisions under state consumer protection law.

Consumer impact (what this means for users)

Users are required to pursue claims individually through arbitration instead of through litigation or class action proceedings. The terms establish that claims arising before agreement to the Terms are subject to this arbitration requirement, and that both parties may bring claims only in individual capacity.

You and Pinterest agree to resolve any claims relating to these Terms or our services through final and binding arbitration, except as set forth under Exceptions to Agreement to Arbitrate below. This applies to all claims under any legal theory, unless the claim fits in one of the exceptions below. It also applies to claims that arose before you agreed to these Terms. The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. YOU AND PINTEREST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
