This is Mistral AI's Terms of Service for people outside Europe who use products like Le Chat and Mistral AI Studio. The most important thing to know is that if you have a free account or a Le Chat Pro or Student subscription, Mistral AI will use your conversations to train its AI models by default unless you actively opt out in your account settings. You should log into your account settings now and opt out of model training if you do not want your conversations used to train AI.
Technical Summary
This document governs personal consumer use of Mistral AI's products (including Le Chat, Mistral AI Studio, and related APIs) by individuals residing outside the European Economic Area, constituting a binding contract upon account creation or product use. Key obligations include user responsibility for Input accuracy and legality, prohibition on reverse engineering or commercial redistribution, compliance with Mistral AI's Usage Policy, and age minimums of 13 years. Notable deviations from industry standard include an opt-out (rather than opt-in) model training clause for free and Le Chat Pro/Student subscribers, a broad feedback data training grant, and a prohibition on using image Outputs to develop competing image generation products. The document engages the FTC Act Section 5 (unfair/deceptive practices), COPPA (age restrictions for under-13 users), CCPA for California residents, and potentially the EU AI Act insofar as Mistral AI is a French entity operating under French law with governing law clauses applying to non-EEA consumers. Material compliance considerations include the opt-out training default for paid subscribers, jurisdiction-specific consumer protection laws that may override non-refund and price change clauses, and Mistral AI's French incorporation creating cross-border data flow implications even for non-EEA users.
If you use a free account or have a Le Chat Pro or Student subscription, Mistral AI will use your conversations to train its AI models unless you go into your account settings and turn this off.
You must be at least 13 years old to use Mistral AI, and if you are a minor, you may need a parent or guardian's permission depending on where you live.
When you click thumbs up or thumbs down on a Mistral AI response, you are granting Mistral AI permission to use not just your rating but also the full conversation that prompted it for AI training — regardless of your other training opt-out settings.
Mistral AI offers voice cloning features but prohibits using them to impersonate anyone without their consent or to create fraudulent, harmful, or deceptive audio content.
Mistral AI says you own the text, images, or other content generated by its AI based on your prompts, and the company assigns any rights it might have in those outputs to you.
Mistral AI can raise its subscription prices at any time, but must give you at least 30 days' notice before any increase takes effect, giving you time to cancel if you disagree.
If you connect external services or tools (like MCP servers) to Mistral AI, the company takes no responsibility for anything that goes wrong with those connections, including data loss.
Mistral AI requires disputes to be resolved in French courts under French law, though your local consumer protection laws may still apply and allow you to sue in your home country.
