REGULATORY FRAMEWORK: Mandatory forum selection clauses in consumer contracts are subject to challenge under FTC Act Section 5 (unfair practices) and various state consumer protection laws. EU users are protected by Regulation (EU) 1215/2012 (Brussels I Recast), which generally grants EU consumers the right to sue in their home jurisdiction regardless of forum selection clauses. The EU Consumer Rights Directive (2011/83/EU) similarly protects consumers' right to domestic forum. UK consumers are protected under the Consumer Rights Act 2015.
