Illinois BIPA and analogous state statutes may be implicated if biometric data is among the content accessible through domain owner administration. FERPA is specifically engaged where educational institutions exercise domain owner access over student accounts. 4. CONTRACT AND VENDOR IMPLICATIONS: Organizations that are Microsoft domain owners should review their data governance frameworks to determine whether they are exercising account administration rights and whether doing so is consistent with applicable employment law, privacy law, and organizational policy. Procurement teams should ensure that Microsoft enterprise agreements adequately define the scope of domain owner access rights and align with organizational data governance commitments. 5. COMPLIANCE CONSIDERATIONS: HR and legal teams at organizations whose domains are associated with Microsoft accounts should assess whether employee or student notice and consent mechanisms adequately disclose the domain owner access rights established by this provision. Data mapping exercises should account for the possibility that organizational access to employee communications and files through this mechanism constitutes processing of personal data requiring documentation under applicable data protection law. Organizations in the EU/EEA should evaluate whether a data processing agreement with Microsoft is required to govern this access.
