What it is

The agreement requires users to report billing errors and disputed charges within 90 days of their appearance on the billing statement. Failure to report within this window results in a release of Microsoft from liability for the error. Purchases are stated to be final and non-refundable unless otherwise provided by law or a specific service offer.

Why it matters (compliance & governance perspective)

This provision establishes a 90-day contractual limitation period for billing disputes and error reporting, after which the agreement states users release Microsoft from liability. The provision acknowledges that statutory rights under applicable law may not be affected, which is a material carve-out for users in jurisdictions with longer statutory dispute windows.

Interpretive note: The enforceability of the 90-day contractual dispute window against applicable statutory consumer protection periods varies by jurisdiction and may be limited where statutory periods are longer.
