The agreement states that Linear owns all Service Data, defined as data collected about the performance and operation of the Service as Customers interact with it, and may use aggregated and anonymized Service Data in any manner, provided that no User Information, User Submissions, or personal identifying information is revealed to any third party.

This provision establishes Linear's unrestricted right to use Service Data once aggregated and anonymized, and asserts Linear's ownership of that data. The practical scope of this right depends on the definition and implementation of aggregation and anonymization standards, which are not specified in this Agreement.
Interpretive note: The agreement does not specify the technical standard or methodology applied to determine whether Service Data is sufficiently aggregated and anonymized, which affects the practical scope of this right under GDPR and CCPA.
Under this clause, interaction with the Service generates Service Data that Linear owns and may use in any manner once aggregated and anonymized, subject to the condition that no User Information, User Submissions, or personal identifying information is revealed to third parties. The agreement does not specify the technical standards applied to determine whether data is sufficiently anonymized.

"As Customer (including its Users) interacts with the Service the Service collects data pertaining to the performance of the Service and measures of the operation of the Service ("Service Data"). Notwithstanding anything else to the contrary herein, provided that the Service Data is aggregated and anonymized, and no User Information, User Submissions, or any other personal identifying information of Customer is revealed to any third party, the parties agree that Linear is free to use the Service Data in any manner. Linear owns all right, title, and interest in and to such Service Data. For clarity, this section does not give Linear the right to identify Customer (including its Users) as the source of any Service Data.Excerpt from Linear's Terms of Service
REGULATORY LANDSCAPE: Anonymization and aggregation of personal data as a basis for unrestricted secondary use engages GDPR recital 26 and the standard that data must be truly anonymized such that re-identification is not reasonably possible. CCPA similarly addresses deidentified data standards. Applicable regulatory guidance may constrain the scope of this provision if Service Data is derived from personal data of EU or California residents and anonymization does not meet the applicable regulatory standard. GOVERNANCE EXPOSURE: Medium. The provision asserts Linear's right to use Service Data in any manner once anonymized and aggregated, but does not define the anonymization methodology or standard applied. Regulatory frameworks, particularly GDPR, may impose requirements on the robustness of anonymization that affect whether this right is exercisable as stated. JURISDICTION FLAGS: EU and EEA Customers face heightened exposure under GDPR's anonymization standards, given that the ICO and EDPB have issued guidance indicating that aggregation alone does not constitute anonymization if re-identification remains reasonably possible. California Customers should assess whether Service Data derived from their Users' interactions qualifies as deidentified under CCPA. CONTRACT AND VENDOR IMPLICATIONS: Procurement teams in regulated industries should assess whether the Service Data provision is consistent with their data governance obligations, particularly where the Service processes sensitive operational or business data whose aggregated patterns could constitute commercially sensitive information even in anonymized form. COMPLIANCE CONSIDERATIONS: Legal teams should request information about Linear's anonymization methodology and assess whether it satisfies the applicable regulatory standard for the Customer's jurisdiction. Data mapping exercises should account for Service Data as a category distinct from User Information and User Submissions, with different ownership and use rights.
