What it is

The agreement requires users to install conformity-required firmware updates within a reasonable time and states that Ledger bears no liability for operating faults that result from failure to install required updates, including security updates.

ConductAtlas Analysis

Why it matters (compliance & governance perspective)

This provision establishes a conditional liability exclusion: Ledger's responsibility for product operating faults is contingent on the user having installed all required updates. This may interact with statutory conformity guarantee rights in EU jurisdictions, where applicable law may impose obligations on the seller that cannot be fully waived by contract.

Interpretive note: The scope of the liability exclusion may be constrained by EU consumer goods conformity directives (Directives 2019/770 and 2019/771) and their national implementations; 'reasonable time' for update installation is not defined in the document.
