This provision disclaims liability for the security of interview recordings, image and likeness data, and responses transmitted during virtual interviews facilitated through the Indeed platform. The disclaimer applies to both job seeker and employer participants and extends to third-party service providers used to facilitate virtual interviews.
Interpretive note: The enforceability of this disclaimer in jurisdictions with biometric privacy statutes (Illinois, Texas, Washington) and GDPR/UK GDPR coverage is uncertain, as statutory rights may supersede contractual disclaimers.
The updated terms state that Indeed may automatically draft job application content based on job seeker profile information and preferences. The drafted content may be AI-generated and subject to Indeed's AI-Generated Content Terms in Section D.9 of the General Terms. The agreement continues to establish that job seekers remain responsible for reviewing, correcting, editing, or deleting any drafted applications or application content before submission. You should review any AI-drafted content carefully to ensure it accurately reflects your qualifications and preferences before adopting and submitting applications.
View change record →The updated terms establish new explicit tax obligations for users. Indeed now states it will calculate and bill applicable taxes based on user location or linked employer location, and users are responsible for any applicable taxes, duties, or levies. Additionally, the terms now state that reducing or canceling sponsored ad budgets will result in loss of access to premium features exclusive to higher budget plans. Previously, the agreement described auto-apply activity as a pricing factor; this reference has been removed from the pricing methodology section.

"TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU UNDERSTAND AND AGREE THAT INDEED OFFERS NO PROTECTION, AND IS NOT RESPONSIBLE FOR SECURING OR PROTECTING, ANY INFORMATION OR DATA YOU SHARE OR TRANSMIT DURING VIRTUAL INTERVIEWS (INCLUDING AUDIO/VISUAL CONTENT, INTERVIEW QUESTIONS/ANSWERS, OR YOUR IMAGE/LIKENESS). 1. REGULATORY LANDSCAPE: This provision engages Illinois BIPA (biometric identifiers including image/likeness in certain contexts), state wiretapping and recording consent laws (Illinois, California, and other two-party consent states), GDPR Article 9 (special categories of data including biometric data) for EU/EEA users, and FTC Act provisions on unfair data security practices. The disclaimer's scope (including 'image/likeness') may interact with state biometric privacy laws in jurisdictions that define biometric data broadly. 2. GOVERNANCE EXPOSURE: High for job seekers in BIPA and similar biometric privacy jurisdictions. The disclaimer of security responsibility for image and likeness data transmitted during virtual interviews, combined with authorization for employers to record and share those recordings, creates potential exposure under state biometric privacy statutes. The 'to the maximum extent permitted by law' qualifier indicates Indeed acknowledges this disclaimer may not be fully enforceable in all jurisdictions. 3. JURISDICTION FLAGS: Illinois BIPA creates heightened exposure for job seekers whose interviews include facial or voice biometric data capture. California's CCPA and CPRA include biometric data as sensitive personal information with specific handling requirements. EU/EEA users retain GDPR rights over biometric and special category data that may limit the enforceability of this disclaimer. 4. CONTRACT AND VENDOR IMPLICATIONS: Employers enabling virtual interview recording through Indeed's platform should assess their own consent and data security obligations with respect to candidate biometric and interview data, independent of Indeed's disclaimer. Recording consent obligations are placed on employers under the Terms, creating a compliance checkpoint for multi-jurisdiction hiring processes. 5. COMPLIANCE CONSIDERATIONS: Job seeker-facing organizations should assess whether their use of Indeed's virtual interview tools is consistent with their own privacy notices and candidate consent frameworks. Employers should document recording consent procedures and ensure compliance with applicable state recording consent laws prior to enabling recording features.
