What it is

The agreement caps Impact's total financial liability to any member at the lesser of fees paid during the membership term or $1,000, regardless of the cause of action. Members who paid no fees are limited to injunctive relief only, unless otherwise permitted by applicable law.

This analysis describes what Impact's agreement states, permits, or reserves. It does not constitute a legal determination about enforceability. Regulatory applicability and practical outcomes may vary by jurisdiction, enforcement context, and individual circumstances. Read our methodology

ConductAtlas Analysis

Why it matters (compliance & governance perspective)

This provision establishes an absolute ceiling of $1,000 on Impact's aggregate financial liability, which may be materially disproportionate to the operational and financial scale of partnership marketing programs managed through the platform. The injunctive-relief-only limitation for non-paying members further restricts available remedies in that category.
