Payment Method Updates and Retry Authorization

Medium severity
Share 𝕏 Share in Share 🔒 PDF

What it is

Hulu can automatically obtain your updated card details from your bank and continue charging you even if your card has expired, and will retry failed payments using any payment method you have stored on your account.

Consumer impact (what this means for users)

This provision means you cannot stop Hulu charges simply by letting your credit card expire — Hulu may automatically receive your new card details from your bank and continue billing you.

What you can do

⚠️ These actions may provide transparency or partial mitigation but may not fully address the underlying issue. Effectiveness varies by jurisdiction and individual circumstances.
  • Dispute a Fee
If you believe you were charged after your card expired due to automatic card updates, log in to your account at www.hulu.com/account to review your billing history. Contact Hulu customer service to dispute the charge, and separately contact your bank or card issuer to dispute the transaction and request that future automatic updates be blocked.

Why it matters (compliance & risk perspective)

Hulu can obtain updated card details from your payment network without you re-entering your information, meaning your subscription can continue being charged even if you thought your expired card would stop it — effectively preventing passive cancellation.

View original clause language
Where your details change or are due to expire, we may obtain or receive from your payment provider updated payment details including your card number, expiration date and CVV (or equivalent). This enables us to continue to provide you access to the Services. You authorize us to continue to charge your card using the updated information. In the event of a failed attempt to charge to your primary payment method (e.g. if your payment method has expired), we reserve the right to retry billing your payment method or, where you have consented, to use any other stored payment method associated with your account.

Institutional analysis (Compliance & legal intelligence)

REGULATORY FRAMEWORK: The automatic card-updater authorization implicates Regulation E (Electronic Fund Transfer Act, 15 U.S.C. § 1693 et seq.) for debit card transactions and Regulation Z (Truth in Lending Act, 15 U.S.C. § 1601 et seq.) for credit card transactions. CFPB guidance requires that recurring payment authorizations be clearly disclosed and that consumers have a meaningful right to revoke authorization. Card network rules (Visa, Mastercard) permit updater services but require disclosure to cardholders. FTC Act Section 5 applies to any deceptive omission of this practice.
